The Vaccine Culture War in America: Are You Ready?

More than 1.2 million people in the United States are infected with HIV ¹ but government officials do not ban HIV infected children and adults from attending school, receiving medical care, being employed, or otherwise participating in society. In fact, there are anti-discrimination laws that guarantee civil rights protections for Americans infected with HIV or living with AIDS. ²

No Discrimination or Societal Sanctions for Infected Citizens

In 2012, public health officials reported that about two million people in America are infected with chlamydia, tuberculosis, syphilis and gonorrhea, ³ and they estimate another three million people are infected with hepatitis C. ⁴ Like those with HIV or AIDS, these citizens are not targeted for discrimination and blocked from getting a public education, being employed or moving freely in society.

Live Polio Vaccinated Children Could Still Attend School

Between 1963 and 1999, doctors gave live oral polio vaccine to millions of healthy American children, who became infected with vaccine strain polioviruses they shed in their body fluids and transmitted, sometimes causing other children and adults to contract vaccine strain polio paralysis and die. ^{5  6} Those with compromised immune systems were at special risk for getting vaccine strain polio and shedding vaccine strain poliovirus for longer periods of time than healthy persons. Yet, children recently given live oral polio vaccine were not excluded from attending school.

Calls for Societal Sanctions After Measles Diagnosed at Disneyland

But in 2015 after a handful of measles cases were identified at Disneyland, suddenly Americans are being asked to surrender civil liberties. We are being asked to discriminate against and condone extreme societal sanctions against fellow citizens, ⁷ including removing religious and conscientious belief vaccine exemptions from state laws ^{8 9} so children cannot attend school without 49 doses of 14 federally recommended vaccines by age six and 20 more vaccinations by age 18. ¹⁰
How did a handful of measles cases at Disneyland turn into a full-scale assault on civil and human rights in America?

12 States Introduce Bills to Eliminate Non-Medical Vaccine Exemptions

Why have politicians in 12 states already filed legislation to eliminate non-medical vaccine exemptions, leaving only a very narrow medical exemption that most people cannot get? ^{11 12}
With 93 percent of pediatricians reporting that parents don’t trust the safety of the government recommended child vaccine schedule, ¹³ why are many of them refusing to provide medical care to children if they have not gotten every dose of every federally recommended vaccine – no exceptions and no questions asked? ^{14 15 16}

Censorship of Speech, Shaming, Imprisonment, MD Licenses Revoked?

Why are editorials calling for censorship of speech ^{17 18} and for parents with unvaccinated children to be hunted down and publicly identified, ¹⁹ sued, ^{20 21} criminally prosecuted and imprisoned, ²² and for doctors who criticize vaccine safety to have their medical licenses revoked? ²³
What is happening right now in America is not about the the measles or public health.

Disneyland “Patient Zero” Never Found – Assumptions Made Anyway

It all started in January 2015 after 320 million Americans ²⁴ had just finished ringing in the New Year and California health officials announced that nine visitors to Disneyland were infected with measles. ²⁵ Two weeks later, the total number of measles cases was 51 but no public health doctor in the country could find “patient zero.” ²⁶ That didn’t stop newspapers from proclaiming that a single “unvaccinated” person with measles spoiled the Magic Kingdom and that measles is invading America because of “a decline in parents having their kids vaccinated.” ^{27 28}

Measles Immunity Wanes, High MMR Vaccination Rate in U.S.

It did not matter that the science shows measles vaccine immunity is not lifelong and wanes, ^{29 30 31 32} just like pertussis vaccine immunity is temporary and wanes, ^{33 34 35} or that it is illogical to put all the blame for measles at Disneyland on 1.8% of children attending school with vaccine exemptions ^{36 37} when 95% of children entering kindergarten have gotten two MMR shots ^{38 39} and only 1% of children under age three are unvaccinated. ⁴⁰ With a grand total of 170 measles cases reported in 17 states by March 2015, compared to 644 cases reported in 27 states last year, ⁴¹ and with 42% of the California-related cases documented to be in unvaccinated persons, while 13% of cases were vaccinated, ⁴² there is no justification for gutting vaccine exemptions in state public health laws.

Witch Hunt Led By Doctors Against Families, Dissenting Doctors

Rational thinking has been the first casualty in this 21^st century equivalent of a 17^th century witch hunt ⁴³ led by defensive doctors in government, industry, academia and media, who are fed up with parents asking them questions about vaccine risks and failures they can’t answer. ^{44 45 46 47}  Assisted by communication conglomerates ⁴⁸ and Astroturfers, ^{49 50 51 52 53} they piously wave the science flag and call parents “anti-social” if they don’t vaccinate ⁵⁴ but completely ignore parents with vaccine injured children talking about how their vaccinated children are never healthy anymore. ⁵⁵ Some of the most vicious attacks have been on families consciously choosing to stay healthy a different way ^{56 57} and on doctors caring for families whose children are unvaccinated or receive fewer vaccines on an altered vaccine schedule. ^{58 59}

The Cultural War on Freedom, Values & Beliefs

After headlines like “What would Jesus do about measles?” ⁶⁰ and “God wants you to vaccinate your children” ⁶¹ marked a new low in American journalism, it became clear that the so-called “vaccine war” ^{62 63} is really a culture war ⁶⁴ on freedoms, values and beliefs that have long defined who we are as a nation. ^{65 66 67} How it is fought and where it ends will determine the kind of nation America will become in the 21^st century.

$100 Billion Vaccine Market in 2025 Featuring Many New Vaccines

The $30 billion global vaccine market today will be worth a projected $100 billion or more in ten years.  ⁶⁸ A lucrative public-private business partnership has been forged between government and the pharmaceutical industry ^{69 70 71 72 73 74} with your tax dollars to develop hundreds of new vaccines. ⁷⁵
Drug companies completely shielded from product liability because Congress and the U.S. Supreme Court have declared vaccines to be “unavoidably unsafe,” ^{76 77} are rushing to licensure genetically engineered vaccines for syphilis, ⁷⁸ gonorrhea, ⁷⁹ herpes,⁸⁰ HIV/AIDS, ⁸¹ tuberculosis, ⁸² chlamydia, ⁸³ hepatitis C, ⁸⁴ e-coli, ⁸⁵ cytomegalovirus, ⁸⁶ ebola, ^{87 88} salmonella, ⁸⁹ norovirus, ⁹⁰ adenovirus, ⁹¹ enterovirus, ⁹² asthma, ⁹³ diabetes, ⁹⁴ obesity, ⁹⁵ high blood pressure, ⁹⁶ anti-smoking, ⁹⁷ anti-cocaine ⁹⁸ and anti-heroin ⁹⁹ use, and many more that Pharma and government will want many  adults, as well as children, to buy and use.

Adult Immunization Plan Targets Women, Employees, Faith Groups

The new National Adult Immunization Plan aggressively targets pregnant women, ¹⁰⁰ employers and their employees, ¹⁰¹ faith based groups ¹⁰²and other adults for increased vaccine use. ^{103  104} Health care workers are already being fired if they do not get an annual flu shot, ¹⁰⁵ a vaccine that works less than half the time and was completely ineffective this year. ^{106 107}
The next profession on the firing line is the teaching profession. ^{108 109} A doctor turned politician in Vermont is pushing a bill to require teachers and everyone working in a school to prove they have gotten government recommended vaccines or be re-vaccinated. ¹¹⁰
Will your profession be next on that list?

Will You Be Prevented From Moving Freely in Society & Punished?

Will laws be passed to not only deny you a public education but prevent you from obtaining health insurance; entering a doctor’s office, hospital or retirement home; boarding a bus, plane or train; buying a ticket for a movie or football game; shopping in a store, getting a driver’s license, filing your taxes or otherwise participating in and moving freely in society unless you show proof you have gotten every government recommended vaccine?
Will your healthy unvaccinated children be taken from you ¹¹¹ and will you be fined and thrown in prison? ^{112 113}
Will public health officials with police power knock on your door one day and take you to a quarantine camp or forcibly administer vaccines to you and your children without your voluntary informed consent?

If Non-Medical Vaccine Exemptions Removed, You Will Have No Choice

Even if you and your children have willingly received every government recommended vaccine today, if non-medical exemptions are removed from U.S. vaccine laws, you will have no choice if you decide you don’t want to use every new liability-free vaccine that government recommends tomorrow.
This vaccine culture war is about a lot more than vaccination.
Because if the State can tag, track down and force you against your will to be injected with biologicals of known and unknown toxicity today, then there will be no limit on which other freedoms the State can take away in the name of the greater good tomorrow.

What You Can Do If You Are Ready to Take Action

Are you ready to fight for your freedom? If you are, here is what you can do:

WITNESS.  If you experienced vaccine reactions and are now chronically ill or disabled, you can share your experience with others. You are not alone.
Vaccine reactions and injuries are not as rare as doctors want to admit to themselves or to patients and parents. ¹¹⁴ Today, everybody knows somebody who was healthy, got vaccinated and was never healthy again.

Talk About What Happened to Your Child After Vaccination

If you are a parent and watched your child scream for hours or collapse, twitch and jerk or regress physically, mentally and emotionally and become a totally different child in the days and weeks after vaccination, ^{115 116 117 118 119 120} you have witnessed a serious event that you can talk about with other people, including legislators representing you in your state Capitol and in Congress.
If your child was revaccinated and you observed the same symptoms or your child’s health got worse, it is compelling scientific evidence of a causal relationship between vaccination and what happened to your child. In scientific studies, this is called challenge/re-challenge ¹²¹ and what you saw is called clinical observation, ¹²² even though when parents do the observing most doctors dismiss what happened as “anecdotal” ¹²³ evidence or a “coincidence” ^{124 125} that has no value at all.

Your Child’s Life Has Value, Don’t Let Anyone Bully and Shame You

What you witnessed happen to your child after vaccination does have value because your child’s life has value. Don’t let a doctor or anyone else bully and shame you into being afraid to talk about what you saw happen after vaccination, especially if your child is now chronically ill or disabled and has been diagnosed with learning disabilities; ADHD; epilepsy; autoimmunity; autism or communication, developmental or disruptive behavior disorders; asthma, allergy or other brain and immune system dysfunction. ¹²⁶
Witnessing about what happened after vaccination is a way to help others understand that every life has value, and no person’s life should be considered expendable, and that we must never forget that universal truth.
REPORT. It is estimated thatonly between 1 and 10 percent of serious vaccine-associated reactions, hospitalizations, injuries and deaths are ever reported to the Vaccine Adverse Event Reporting System (VAERS), ^{127 128} even though federal law requires all vaccine providers to make reports. Now, I am going to review five myths and facts that will help you understand what the vaccine culture war is really about:

VACCINE CULTURE WAR MYTH NUMBER 1:

Most medical doctors say that vaccines do not cause

 Injury or death, so it must be true. 

 

Doctors who say vaccines are safe for everyone and do not cause injury and death are either uninformed, in denial or lying. Since the first vaccine for smallpox, doctors have known and it has been well documented that brain inflammation, permanent brain damage and death have always been among most serious complications of vaccination. ^{129 130}

Just like any other pharmaceutical product, vaccines carry a risk of injury or death. These risks can be greater for some people with genetic, biological and environmental risk factors that doctors do not understand or cannot predict. ¹³¹

Congress, U.S. Supreme Court Say Vaccines Are “Unavoidably Unsafe”

Knowing this, Congress in 1986 ¹³² and the U.S. Supreme Court in 2011 ¹³³ declared vaccines to be “unavoidably unsafe” and shielded drug companies from all product liability. ¹³⁴ If you or your child are injured or die after vaccination, you cannot hold the drug company that makes and profits from the vaccine or anyone who regulates, promotes, administers or mandates the vaccine accountable in a civil court of law in front of a jury of your peers.

Liability for Seat Belt Manufacturers - NOT for Vaccine Manufacturers

Seat belt manufacturers have product liability ¹³⁵ but vaccine manufacturers do not. Doctors can be sued for malpractice except when they administer vaccinations that injure or kill a person.

Vaccines are the only product government mandates and completely indemnifies.

The federal government has paid $3 billion dollars in compensation to victims of vaccine injury and death under the National Childhood Vaccine Injury Act of 1986. ¹³⁶

VACCINE CULTURE WAR MYTH NUMBER 2:

People who question vaccine safety are ignorant and

 do not understand the science.

 

Just the opposite is true. Most people who question vaccine safety are very intelligent and understand the difference between good science and bad science. ^{137 138 139}

Studies reveal that mothers and fathers with college or post-graduate degrees are the ones who most often question the safety of vaccines. ^{140 141 142} They are wondering whether government policy directing pediatricians to give children three times as many vaccinations as children got 30 years ago ¹⁴³ is safe, effective and necessary.

Big Knowledge Gaps in Vaccine Safety Science

If growing concerns among parents about vaccination was simply due to ignorance, two decades of reports published by the Institute of Medicine would not have found large knowledge gaps in vaccine safety science. ¹⁴⁴ For example, there are fewer than 40 published studies evaluating the safety of the federally recommended child vaccine schedule for infants and children under age six. ¹⁴⁵

VACCINE CULTURE WAR MYTH NUMBER 3:

People who do not vaccinate are selfish and

don’t care about the public health. 

 

While we are all born equal with equal rights under the law, we are not born all the same. Each one of us is born with different genes and a unique microbiome  influenced by epigenetics ¹⁴⁶ that affects how we respond to diseases ^{147 148} and pharmaceutical products like vaccines. ^{149 150}

Many Americans no longer vaccinate today because the risks of vaccination turned out to be 100 percent for them, their children or other family members. They have good reason to believe that the genes they were born with make them more susceptible to vaccine harm. ^{151 152 153 154 155}

Vaccine Vulnerable Families Can’t Find Doctors to Write Medical Exemptions

But often these former vaccinators cannot find a doctor to write a medical exemption because almost no health condition qualifies for a medical exemption to vaccination anymore. ¹⁵⁶ Unless you are dying of cancer and on chemotherapy, have had a recent organ transplant or have the most severe combined immune deficiency, most doctors will not grant you a medical vaccine exemption. ¹⁵⁷

Non-medical vaccine exemptions are the only way vaccine vulnerable families  can protect their lives.

Some Healthy Americans Choosing Different Path to Health

Some Americans use fewer vaccines or remain unvaccinated because they have chosen a different path to health. They focus on boosting immune function with good nutrition, exercise, avoiding environmental toxins and using holistic health alternatives that do not rely on heavy use of pharmaceutical products. ^{158 159 160 161} They are contributing significantly to the public health because they and their children are very healthy.

It is not selfish to want to make informed choices about how to stay healthy. It is not selfish to protect yourself and your children from harm, especially if you believe your family is more susceptible to vaccine injury. If everyone protects their own health and the health of their children, the public health will be protected.

VACCINE CULTURE WAR MYTH NUMBER 4:

Science trumps religious beliefs so

religious exemptions to vaccination should be eliminated. 

 

The attack on Americans with religious or spiritual beliefs is central to the political agenda driving this cultural war. ^{162 163 164} Fellow citizens, who do not believe there is a God, ^{165 166 167 168} are demanding that those who have faith in God be required to place the same faith in science and doctors. ¹⁶⁹

There is a big difference between fallible human beings and God, but some doctors do not understand this difference.

Vaccine Developer Ridicules Religious Belief, Quotes Scripture

One prominent pediatrician vaccine developer, ¹⁷⁰ who insists that babies can safely be given 10,000 vaccines on the same day, ¹⁷¹ has publicly ridiculed religious beliefs ^{172 173 174} but now is hypocritically quoting holy scripture ¹⁷⁵ and comparing Disneyland to the “Garden of Eden.” ¹⁷⁶ Invoking the name of Jesus, he is trying to shame Christian parents refusing to obey his orders to give their children every government recommended vaccine, including the one he created ¹⁷⁷ that has made him a very rich man. ^{178 179 180}

Mothers Responsible for the Health of Their Children

I remember many years ago when a public health doctor promoting the “No Shots, No School” campaign in America suggested I was “selfish” for declining to give my two youngest children pertussis vaccine even though my oldest son was DPT vaccine injured. Implicit was the suggestion that I had no right to protect my own children’s health if it conflicted with what doctors believe protects the public health.

I looked him straight in the eyes and said “Doctor, whether or not I put my child’s life on the line for you and your vaccine is between me and my God and not between me and you.”

As mothers, we carry our babies inside us for nine months, we give birth, we love them more than we thought we could ever love anyone and we nurture them throughout childhood so they can grow up to be productive adult members of society. We are responsible for their health and we are the ones who care for them when they become sick and unable to care for themselves for any reason, and we are the ones who weep at their graves if they die before we do.

Do Not Let Anyone Violate Your Religious, Conscientious Beliefs

You do not have to belong to an organized religion or state recognized church to hold sincere religious or spiritual beliefs about health and vaccination. ^{181  182 183}   As a mother or father, you have the God given natural right to use the brain and gut instincts God gave you to consider the evidence, examine your conscience, pray for guidance and exercise the human right to informed consent to medical risk-taking on behalf of your minor child. Do not let a doctor, government employee or politician take that God given right away from you.

It is a violation of religious freedom to force vaccination when you hold religious or spiritual beliefs opposing use of one or more vaccines and it is a violation of the human spirit to force you to disobey the certain judgment of your conscience.

VACCINE CULTURE WAR MYTH NUMBER 5: 

It is ethical for government to sacrifice the few for the many.

 

Based on hedonism ¹⁸⁴ and a mathematical equation, this philosophy is called utilitarianism ¹⁸⁵¹⁸⁶and comes from the word “utility.” ¹⁸⁷ The utilitarian rationale was created as a guide for legislators making public policy by an 18^th century British social reformer Jeremy Bentham, ^{188 189} whose mummified head is being preserved by the University College London, where a wax version is on public display. ¹⁹⁰ In 1905, the U.S. Supreme Court used Bentham’s utilitarian rationale to rule in Jacobsen v. Massachusetts that state legislatures had the power to enact mandatory smallpox vaccination laws. ¹⁹¹

American Eugenicists, U.S. Supreme Court Embraces Utilitarianism

American eugenicists and social reformers embraced utilitarianism in the early 20^th century. ^{192 193} 

They argued that government has the legal right to discriminate against a minority of citizens judged to be genetically defective or a threat to the health and welfare of society.  In 1923, U.S. Supreme Court justice Oliver Wendall Holmes ¹⁹⁴ gave the green light to the state of Virginia to forcibly sterilize a young woman, Carrie Buck, because doctors judged her to be mentally retarded just like her daughter and mother.

Coldly, Holmes proclaimed: “three generations of imbeciles are enough” and said “The principle that sustains compulsory vaccination is broad enough to cover cutting the fallopian tubes.” ¹⁹⁵

It turns out Carrie Buck was not mentally retarded and neither was her daughter or mother. ¹⁹⁶

Utilitarianism Pseudo-Ethic In Its Most Extreme Form

Doctors and public health officials in the Third Reich implemented utilitarianism in its most extreme form to justify conducting horrific scientific experiments on captive people. ^{197 198} The Nuremberg Tribunal justices presiding over The Doctors Trial after World War II declared utilitarianism to be a pseudo ethic. They issued the Nuremberg Code outlining the informed consent principle, ^{199 200} which has guided research on humans and the ethical practice of medicine ever since. ^{201 202 203}

Forced Vaccination Laws Sacrifice the Genetically Vulnerable

The Institute of Medicine has confirmed that some individuals have known and unknown genetic risk factors that make them more susceptible to vaccine injury and death. ²⁰⁴ This means forced vaccination laws that fail to include flexible medical and non-medical exemptions become a utilitarian, de facto selection of the genetically vulnerable for sacrifice. ²⁰⁵

Is America really going to walk down that road? Are we going to punish citizens for the genes they were born with in the name of the public health?

Are we going to slide down the slippery slope of utilitarianism and ignore the profound ethical and legal questions that remain: Who gets to decide what protects the public health? Which individuals should be sacrificed? And how many is too many?

Industry & Government Fail to Fund Good Vaccine Safety Science 

Industry ²⁰⁶ and government have refused to fund good science to better understand the biological mechanisms for vaccine injury and death, and whether there are important health differences between vaccinated and unvaccinated people, ²⁰⁷ and whether increased vaccine use during the past 30 years is a major co-factor in the unexplained chronic disease and disability epidemic plaguing America.

With 1 child in 6 diagnosed with learning disabilities, ²⁰⁸ 1 in 9 with asthma, ^{209 210} 1 in 50 with autism ²¹¹ and 1 in 400 with diabetes ^{212 213} and millions of Americans suffering with cancer and other immune and brain disorders that cost our nation $3 trillion dollars a year to treat,^{214  215 216 217} isn’t it time for government to explain to taxpayers exactly why vaccine safety science should be left off our nation’s scientific research agenda?

Perhaps they already know they don’t have to do that because they are getting laws passed to hunt down and vaccinate every last child and adult in America. Eliminating non-medical vaccine exemptions will guarantee that scientific evaluation of health outcome differences between vaccinated and unvaccinated people in America will never be done.

Police with Dogs: Vaccinating Kids in Maryland

"In Germany, they came first for the Communists, and I didn't speak up because I wasn't a Communist. Then they came for the Jews, and I didn't speak up because I wasn't a Jew. Then they came for the trade unionists, and I didn't speak up because I wasn't a trade unionist. Then they came for the Catholics, and I didn't speak up because I was a Protestant. Then they came for me, and by that time no one was left to speak up." - Martin Niemueller

I watched them bundled up against the cold winter air on Saturday, November 17, 2007, with their children and the letter from the State of Maryland threatening them with imprisonment or fines of $50 a day for failing to show proof their children had gotten a chickenpox or hepatitis B shot. Confused, angry or scared but mostly resigned, they were working mothers and fathers trudging toward the courthouse to face the Judge ordering them to get vaccinated or go to jail. Patrolling the scene was a SWAT team of policemen with dogs.

There were a few vaccine safety and informed consent advocates who showed up to witness what happened at the Prince George's County Courthouse, among them Washington D.C. Attorney Jim Moody and autism activist Kelli Ann Davis, of SAFEMINDS and Charles Frohman, representing the American Association of Physicians and Surgeons (AAPS) http://www.aapsonline.org/press/nr-11-16-07.php as well as several Moms with children who developed autism after vaccination.

The U.S. media turned out but they were kept behind barricades and denied access into the building, as were the advocates and other members of the general public. There was no public oversight on what was happening to the parents and children inside.

I listened to or spoke with several mothers leaving the building with their children and learned the sad truth about what was happening behind the closely guarded, closed doors of the Courthouse. The parents were not being asked questions about their child’s medical history or whether the children had experienced health problems after previous vaccinations. The parents were not being given information about vaccine side effects or how to monitor their children for signs of vaccine reactions. They were not given forms for religious and medical exemptions to vaccination allowed in Maryland (see the video of my debate on CNN the day before with Vanderbilt’s Bill Schaffner, M.D. plus a video of a Saturday CNN interview with Jim Moody http://www.cnn.com/2007/US/11/17/maryland.vaccines/index.html#cnnSTCText)

Apparently, the children were being re-vaccinated with not just hepatitis B and chicken pox vaccines, the two new vaccines added to the Maryland school requirement list, but also with other required vaccines for which the public school system could find no record. One mother told me her children were up-to-date on their shots but the school system lost the records and she had to give her children all the required vaccines on the spot or face jail or fines.

My son, Chris, who became learning disabled after suffering a serious reaction to a fourth DPT shot in 1980, traveled with me to Maryland carrying a camera. After growing up watching his Mom work to change one-size-fits-all vaccine policies that were responsible for his vaccine reaction, Chris recently decided he wants to help NVIC put a face on what it means to be vaccine injured in America and what it means when Americans do not have the right to freely exercise informed consent to vaccination.

Chris set up his camera as I talked with a mother hundreds of yards from the front of the Courthouse door. I was about 12 inches inside a row of large cement balls that apparently were erected as a barrier to prevent terrorist attacks. I did not know I wasn’t supposed to be talking with this Mom inside the barrier. She was telling me about how she wasn’t given any information about vaccines before her children were injected with three vaccines.

All of a sudden, out of the corner of my eye I saw an armed guard with a dog emerge from the Courthouse and walk toward us. I got a sick feeling in the pit of my stomach. It was the dread that any citizen of any country in any century has ever felt when an armed guard with a dog starts advancing. As if we were common criminals or terrorists, he yelled and gestured to us to move behind the stones.

We moved without a word. And the sick feeling in the pit of my stomach told me we were being shown the power of the State wielded by that armed guard with the dog, just as parents inside the Courthouse were being shown the power of the State wielded by doctors with syringes.

There has been talk this past week about whether or not U.S. vaccine laws are, indeed, laws or whether they are simply recommendations that do not have the force of law behind them. Because the enactment of public health laws was not defined in the U.S. Constitution as a federal activity, in 1905 the U.S. Supreme Court affirmed the power of the states to pass public health laws requiring citizens to be vaccinated or re-vaccinated. http://biotech.law.lsu.edu/cases/vaccines/Jacobson_v_Massachusetts.htm

There is now more than 100 years of case law reinforcing the U.S. Supreme Court decision and the right of states to exercise police power to enforce vaccine laws. The post-911 enactment of the Homeland Security Law, the Model State Health Emergency Powers Act and Bioshield I and II makes it clear that the State will use police power to enforce quarantine or vaccination whenever the State chooses to wield that power. http://www.nvic.org/2005_11-15_NVIC_Sen%20Burr_BioShield%202_v7.pdf

The method of punishment for not obeying U.S. state vaccine laws is up to the state legislatures which make the laws. Today, many state legislatures have turned over vaccine law-making to unelected government health and education officials, who may enlist state attorneys and judges in the court system to enforce punishments. One of the punishments which many states have chosen when children have not received all state mandated vaccines is to bar children from attending school unless they file and the State approves exemptions to vaccination outlined by the State.

Those parents, who do not vaccinate their children and do not either make arrangements with the State to homeschool them or successfully file a state-approved exemption, are in violation of another state law: truancy laws. Failure to send your child to school in Maryland between the ages of 5 and 16 is a misdemeanor punishable by fines and jail time or both. This is the law which the Maryland government officials moved to enforce when they enlisted the help of State’s Attorney Glenn Ivey (D) and Judge C. Philip Nichols to turn parents of unvaccinated children into criminals.

In one news report, Judge Nichols was quoted as observing that the children looked unhappy waiting in line for their vaccinations. He is quoted as saying “It’s cute. It looks like their parents are dragging them to church.”

The big difference between being dragged into a Courthouse to get vaccinated and being dragged to church is that an hour of prayer rarely results in catastrophic brain injury or death. I still wonder how many of those children, who were injected with multiple vaccines in the Courthouse, are having vaccine reactions today. Their parents, many of whom are uninformed about how to recognize vaccine reactions, will never know what happened to their children if they regress into chronic poor health after the shots they were forced to get on Saturday.

In 1996, a sixteen year old Milwaukee boy was handcuffed, stripped and jailed overnight because he hadn't shown public school or county health authorities proof that he had gotten a second MMR shot. In 1997, I made a presentation to the National Vaccine Advisory Committee defending the moral right to exercise a conscientious belief exemption to vaccination and predicting what would happen if Americans did not win that freedom. http://www.nvic.org/Loe_Fisher/blfstmt050297.htm

What happened in Maryland this weekend is a final wake-up call for America.

Dozens of new vaccines are being rushed to market in the next decade and most will target children and adults for mandated use. Limiting the power of the State to force vaccination is all that stands between the people and tyranny.

There is only one way we will be free in the future: the laws must be changed so that every state allows a conscientious belief exemption to vaccination. Parents in Texas, after working with Parents Requesting Open Vaccine Education (PROVE) to educate the Texas legislature about the need for a conscientious belief exemption, got that exemption added in 2004 (http://www.vaccineinfo.net/). NVIC provided information and strategic support for PROVE's seven year effort to secure strong informed consent and privacy protections in Texas vaccine laws but it was Dawn Richardson, Rebecca Rex and the people of Texas who got the job done.

As more and more Americans witness healthy children regressing after being repeatedly injected with dozens of doses of vaccines and becoming learning disabled, hyperactive, asthmatic, autistic and diabetic, more parents want to be able to make better informed, voluntary choices about vaccination. There is nothing like the first-hand experience of watching your child or grandchild regress within days or weeks of being injected with 5 to 10 vaccines and become a totally different child physically, mentally and emotionally, to persuade you to investigate legal avenues for avoiding more vaccines that could cause more harm. So it is not surprising that the Associated Press found that a greater number of parents today are seeking religious exemption to vaccination in the 28 states that do not allow a personal, philosophical or conscientious belief exemption to vaccination.

The vaccine safety and informed consent movement that was launched by parents of DPT vaccine injured children in 1982 has gained momentum with each new vaccine added to the mandatory list for school entry since that time. Primarily a grassroots movement powered by the educated middle class, where most successful social revolutions in technologically advanced countries begin, citizen activists are pointing out serious gaps in the quality and quantity of the scientific evidence supporting the cradle to the grave approach to vaccination adopted by government officials over the past quarter century. They are advocating that doctors be required to adhere to the informed consent ethic when administering vaccines.

It is this intellectual challenge to the validity of the science and ethics of forced vaccination policies that makes the doctors who operate and profit from mandatory vaccination policies so angry. They are not used to well informed, articulate health care consumers challenging their wisdom and demanding equality in making health care decisions for children. Angry that their authoritarian, paternalistic stance is not playing well in middle America anymore, some doctors are turning their anger into a desire for revenge.

While educated Americans challenge the scientific and moral basis for legally requiring citizens to use multiple vaccines throughout life, forced vaccination proponents like rotavirus vaccine patent holder and Merck consultant, Paul Offit, M.D., are leading an unprecedented assault on the philosophical and religious belief exemption to vaccination. Dismissing parental concern about vaccine risks as an "irrational, fear based decision," he and his colleagues want to socially ostracize and legally punish those who approach maintaining health and wellness in a different way and decline to purchase and use every vaccine industry produces and government recommends.

On September 15, Dr. Offit sponsored a "Vaccine Education Symposium" at the Children's Hospital of Pennsylvania which featured speakers such as Dan Salmon, Ph.D., who has alleged that exemptions to vaccination are not protected by the U.S. Constitution and should be eliminated or severely curtailed

At the symposium, discussions involved (1) requiring vaccination of all nurses and other health care workers as a condition of employment; (2) passing laws to facilitate prosecution of parents of unvaccinated children for economic damages when vaccinated children contract vaccine preventable diseases; (3) routine posting and publishing of lists of unvaccinated individuals in public places in communities; and (4) prosecuting parents who homeschool their children for child neglect if they do not vaccinate them.

The military approach to dissent is a risky one as it threatens to fatally compromise what is left of the sacred trust that exists between pediatricians and parents. But this approach has become much more common since September 11, 2001, when doctors and public health officials viewed that tragic event as an opportunity to aggressively promote vaccination and disease control as a matter of national security.

State mandatory vaccination laws have their roots in the 1905 U.S. Supreme Court decision, Jacobsen v Massachusetts. A Swedish Lutheran pastor, Reverend Henning Jacobsen and his son objected to a law requiring revaccination with smallpox vaccine because they had suffered severe reactions to the first vaccination. The nine Supreme Court justices at the turn of the century denied Jacobsen and his lawyers the right to present scientific evidence for harm caused by the smallpox vaccine, preferring to believe the lawyers representing public health officials who convinced them that doctors could predict ahead of time who would be injured by vaccination.

In the majority opinion, the Justices demonstrated a remarkable blind faith, bordering on religious conviction, in the infallibility of medical doctors and the safety of smallpox vaccination. The Court stated that "The matured opinions of medical men everywhere and the experience of mankind as all must know, negative the suggestion that it is not possible in any case to determine whether vaccination is safe."

Only briefly did the Justices address the issue of individual susceptibility to the potentially harmful effects of vaccination when they stated that mandatory vaccination must not be forced on a person whose physical condition would make vaccination "cruel and inhuman to the last degree. We are not to be understood as holding that the statute was intended to be applied in such a case or, if it was so intended, that the judiciary would not be competent to interfere and protect the health and life of the individual concerned. All laws should receive sensible construction."

Of course, in the succeeding 100 years since that Supreme Court decision affirming the power of the state to "keep in view the welfare, comfort and safety of the many and not permit the interests of the many to be subordinated to the wishes or convenience of the few," it has become clear that doctors cannot determine ahead of time who will be harmed by vaccination and that many more than a "few" have been injured or died from the effects of mass use of multiple vaccines in childhood as evidenced by the nearly two billion dollars paid to vaccine victims by the government since 1988.

An interesting historical fact about the fallout of the ethically flawed Jacobsen v Massachusetts decision is its citing by US Supreme Court justice Oliver Wendall Holmes in 1927 to justify the eugenics- movement inspired forced sterilization of a mentally retarded girl. Holmes agreed that the state could compel the young girl to be sterilized because "the principle that sustains compulsory vaccination is broad enough to cover cutting the fallopian tubes."

Since 1905, the majority of states have provided for medical, religious and/or philosophical, personal belief or conscientious belief exemption to vaccination. Today, all but two states allow religious exemption to vaccination.

Since 1905, the numbers of vaccines recommended by doctors and required by state law has increased from one vaccine - smallpox - to nearly three dozen doses of 10 to 12 vaccines.

In the past, some states have required that an individual belong to a church or religion that adheres to a tenet opposing vaccination. However, when that restrictive language has been challenged at the state Supreme Court level, it has been struck down as unconstitutional (Sherr v. Northport-East Northport Union Free Sch. Dist., 672 F. Supp. 81, 89-90 (E.D. N.Y. 1987). Today, the exercise of religious exemption to vaccination usually requires a citizen to hold a sincere personal spiritual or religious belief that does not have to be tied to a specific church or religion. In some states, parents are required to either write a notarized statement and/or also obtain a letter from their spiritual advisor attesting to their sincere religious beliefs regarding vaccination.

The religious belief exemption is provided under the law for citizens who believe in a Creator and engage in prayer and may also consult scripture for guidance in making vaccination decisions which are spiritually based. Many parents of Christian, Jewish, Muslim and non-denominational spiritual beliefs, who already have a vaccine injured child, are engaging in prayer and consulting scripture for guidance in making vaccination decisions for their other children. It is important for the religious exemption to vaccination to only be taken by those who truly hold sincere religious or spiritual beliefs regarding vaccination.

The 18 states which allow philosophical, personal or conscientious belief exemption to vaccination are the states which come the closest to allowing voluntary, informed consent to vaccination in America. NVIC supports the addition of conscientious belief exemption to all state vaccine laws, such as the law in Texas obtained in 2004 by parents led by Dawn Richardson, president of Parents Requesting Open Vaccine Education (PROVE), so citizens without sincere religious beliefs opposing vaccination can exercise a conscientious belief exemption.

Although pro-forced vaccination proponents are promoting the demonization and punishment of parents who advocate informed consent to vaccination, including the right to take a religious or conscientious belief exemption, they do not have a strong ethical basis for their position. The genetic co-factor involved in adverse responses to vaccination make one-size- fits-all forced vaccination laws a de facto selection of the genetically vulnerable for sacrifice and that kind of government policy should not be tolerated by any state.

As more children regress into poor health after vaccination and more parents discover that vaccines carry far greater risks than pediatricians and public health officials have admitted to date, there will be a greater public demand for flexibility in mandatory vaccination laws. Paul Offit and his cohorts would do well to respect and acknowledge genetic diversity and the need for informed consent protections in mandatory vaccination laws rather than attempt to turn enforcement of those laws into a military operation. That primitive approach will not survive the test of time.

The Vaccine Injured: Where Has Compassion Gone?

During this season of remembrance and thanksgiving, I am grateful for the blessings that I have had in my life, including the hard times, when I learned that faith and hope can overcome fear and doubt. Adversity can make us stronger but it is also an opportunity to feel and offer compassion to others to ease their suffering.

In great numbers,[1] Americans reach out to help victims of hurricanes,[2] floods, earthquakes,[3] poverty,[4] violence[5] and disease.[6] Journalists often profile individuals, who are suffering from adversity: the earthquake survivors in Haiti;[7] the victims of hate crimes;[8] children living in poverty dying from starvation and neglect.[9] These stories of human suffering are reminders of why we should listen to our conscience[10] and act in compassionate ways to lessen the suffering of others.

The ability to have compassion for others is an antidote to cruelty, inequality, injustice, and tyranny.

Valuing Individual Life, Freedom & Compassion

America was founded by men and women immigrants, who had personally suffered oppression and adversity, and knew how important it is to treat individuals with respect and compassion. There is a ringing endorsement in the U.S. Declaration of Independence for the individual’s right to life, liberty and the pursuit of happiness,[11] and in the Constitution for the right to freedom of speech and personal religious beliefs.[12] Perhaps it is that fundamental appreciation for the value of the individual, which is part of our history and culture, that has taught us to value conscience and compassion.

Vaccine Injured Not Treated with Compassion

So it is sad to see what happens in America today when babies, children and adults react to vaccines and become permanently injured or even die.[13] [14] [15] [16] When healthy people suffer complications from infectious diseases, they are treated with compassion.[17] [18] [19] [20] But when healthy people suffer complications from vaccination, often they are not treated with compassion.[21] [22] Many times, vaccine victims [23] [24] [25] are victimized all over again by those, who deny the reality of what happened [26] [27] [28] or use a utilitarian [29] [30] [31] rationale to dismiss them as acceptable losses in the War on Infectious Disease.[32] [33] [34] [35]

Media Failing to Protect Vaccine Injured & Safety Advocates

In the past decade, this persecution of a growing minority of vaccine-injured citizens has been facilitated by the fourth estate,[36] the free press, which has historically served as a check and balance on inequality and injustice in America.[37] The vital function of a free press, ensured in the U.S. Constitution, is failing to do what it could do to protect the health and lives of the vaccine injured[38] [39] or defend freedom of speech for citizens calling for inclusion of vaccine safety and informed consent protections[40] in public health policies and laws,[41] [42] [43] while the chronic disease and disability epidemic destroys the health and economic stability of our nation[44] [45] [46] [47] [48] and the public health community has no answers, so the band plays on.

Institute of Medicine Acknowledges Vaccine Safety Science Gaps

The Institute of Medicine issued an historic report this year that acknowledged there is not enough quality vaccine science in the medical literature to determine whether or not many of the vaccines routinely given to children and adults cause more than 100 different types of brain and immune system dysfunction.[49]

These are serious inflammatory brain and immune system disorders, which are part of the exploding chronic disease epidemic in America, and range from heart and blood disorders to strokes, sudden infant death syndrome, asthma, multiple sclerosis, fibromyalgia, GBS, rheumatoid arthritis, lupus, diabetes and encephalitis that can lead to seizures, learning disabilities and autism.

Institute of Medicine Acknowledges Individual Biological Susceptibility

In that historic report, the Institute of Medicine also acknowledged there are pre-existing biological susceptibilities that can make some individuals more vulnerable than others for suffering harm from vaccination, such as genetic variations; age or developmental stage at the time of vaccination; coinciding illness or other environmental exposures.[50]

If one-size-fits-all vaccine policies and mandates are putting an unknown number of biologically susceptible individuals at risk for injury and death, why do so few doctors care or want to do something about it?

Doctors Denying Medical Care to Families

It is disturbing to watch doctors, who we have always believed to be the most compassionate among us, coldly turn away families questioning the government policy of giving children 69 doses of 16 vaccines.[51] [52] Families wanting to choose or delay vaccines, are being denied medical care even if children have experienced previous vaccine reactions or have become chronically ill and disabled after vaccination and could be made sicker if more vaccines are given.[53]
How unethical.

Doctors Tell Employees: Get Vaccinated or Be Fired

It is shocking that health care professionals are being threatened by doctors running hospitals and medical facilities that, if they do not obey orders to get an annual flu shot, they will be fired [54] [55] [56] - even if they are pregnant; have had previous vaccine reactions or have medical conditions that could be made a lot worse if they get more vaccines.[57]
How heartless.

Doctors Strip Parents of Legal Right to Make Vaccine Decisions for Minor Children

It is hard to accept that doctors we have trusted are pressuring our elected state legislators to pass laws stripping us of the legal right to make medical risk decisions for our children so minor children can be given vaccines without a parent’s knowledge or consent.[58] [59]
How dangerous.

Pharma Funded Doctor Associations Attack Vaccine Safety Advocates

It is frightening to know that medical trade associations and doctors taking money from drug companies[60] [61] [62] [63] are mounting disinformation campaigns to demonize vaccine safety advocates[64] and censor public access to information about health and vaccination so the American people cannot make fully informed vaccine decisions.[65]
How ignorant.

Mainstream Media Facilitates Public Attacks on Advocates

And it is tragic to witness the mainstream media facilitating the public attack on vaccine victims and those calling for a move away from one-size-fits all vaccine mandates[66] [67] that punish individuals, who are biologically vulnerable to vaccine reactions in part because of the genes they inherited.[68] [69]
How cruel.

Vaccine Makers & Doctors Giving Vaccines Shielded from Liability

In 1986, Congress passed a law acknowledging that vaccines can and do cause brain and immune system damage and that more should be done to protect individuals from vaccine injury and death.[70] In that law, Congress shielded drug companies selling vaccines and doctors giving vaccines from civil lawsuits when someone is seriously injured or dies after being vaccinated.
So why are doctors, who are shielded from liability, so unwilling to treat vaccine injured children and their families with compassion or understand the need for people to have the freedom to protect themselves and their loved ones from vaccine injury?

Loss of Compassion Leads to Exploitation

When you enter the Holocaust Museum in Washington, D.C., you see an inscription that says “The first to perish were the children…. From these a new dawn might have risen.”[71]

The loss of compassion and, then, freedom in any society always begins with people looking the other way when those in power justify exploiting a vulnerable minority for what they say is the benefit of the majority.

NVIC: Three Decades of Defending Informed Consent Rights

I pray that they find it in their hearts to replace their fear, anger, doubt and prejudice with compassion and take positive steps to accurately count and minimize the numbers of vaccine casualties rather than dismissing them as a “coincidence” or unimportant.
